Welcome to Rocky. By downloading, installing, or using the Rocky application ("App"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By accessing or using Rocky, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, please do not use the App.

2. Description of Service

Rocky is a rock and mineral identification application that allows users to:

• Identify rocks, minerals, crystals, and gemstones using AI-powered image recognition
• Learn about geological specimens, their formation, and properties
• Build a personal collection (Rockdex) of discovered rocks
• Receive information about hardness, collector value, and uses
• Earn XP, level up, and unlock badges
• Share rock discoveries as collectible cards

4. User Accounts

Rocky does not require you to create an account. Your collection data, XP, and progress are stored locally on your device. You are responsible for maintaining the security of your device and any data stored within the App.

5. Subscription and Payments

Rocky offers both free and premium subscription tiers:

• Free Tier: Allows a limited number of free rock scans with basic features.
• Rocky Pro: Offers unlimited rock scans, full collection features, and all premium content.

Premium subscriptions are billed through your Apple ID account. Payment will be charged at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. You can manage and cancel your subscription in your Apple ID Account Settings.

6. Free Trial

We may offer a free trial period for premium features. If you do not cancel before the trial ends, you will be automatically charged for the subscription. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

7. Refunds

All purchases are processed by Apple and are subject to Apple's refund policies. To request a refund, please contact Apple Support or use the "Report a Problem" feature in your purchase history.

8. Identification Accuracy

While Rocky uses advanced AI technology for rock and mineral identification, we cannot guarantee 100% accuracy. Identifications are provided for informational and entertainment purposes only. Important notes:

• AI identifications may not be accurate for all specimens
• Value assessments are general guidelines, not professional appraisals
• Rarity classifications are based on general geological occurrence
• For valuable specimens, always seek professional evaluation
• Hardness and property information is general guidance

9. User Content

You retain all rights to the photos you take using Rocky. By submitting images for identification, you grant us a limited license to process those images for the purpose of providing the identification service. We do not store your images after processing.

10. Intellectual Property

The Rocky App, including its design, features, code, rock information database, and branding, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.

11. Prohibited Uses

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's functionality
• Reverse engineer, decompile, or disassemble the App
• Use automated systems to submit excessive identification requests
• Remove or alter any proprietary notices or labels
• Use identification results for fraudulent purposes or misrepresentation

12. Disclaimer of Warranties

Rocky is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or free of viruses
• Rock identifications will be 100% accurate
• Value assessments will reflect actual market prices
• Property information will be suitable for all purposes

Rocky is intended for informational and entertainment purposes only and is NOT a substitute for professional geological or gemological advice.

13. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from:

• Your use or inability to use the App
• Reliance on rock identification or value information
• Any purchasing or selling decisions based on App information
• Any unauthorized access to your data
• Any interruption or cessation of the App

14. Data Loss

Since your collection data is stored locally on your device, you are responsible for your data. We are not responsible for any data loss that may occur due to device failure, app deletion, or other circumstances.

15. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by updating the "Last updated" date. Your continued use of the App after any changes constitutes acceptance of the new Terms.

16. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to its conflict of law provisions.

18. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish its objectives to the greatest extent possible, and the remaining provisions will continue in full force and effect.
